A very bad news is coming for Shiksha Mitra of Uttarakhand. Just like Uttar pradesh, High court of UK canceled the Samayojan of those candidates who are not TET Teacher eligibility Test qualified. As we know TET is compulsory for all teachers for appointment as assistant teacher in government, Government aided schools. TET is also compulsory for teaching in primary level from class
1 to class 5 level in navodaya vidyalaya NVS, KVS kendriya vidyalaya, army public school and other central and state government schools. But state government of uttar pradesh as well as Uttarakhand did appointment of working shiksha Mitra in government primary on the posts of sahayak adhyapak. That’s why ucch nyayalaya of Uttarakhand now said that appointment without TET will be dismissed. Court ordered in their Judgment / decision to remove such SM AT teacher who is not Tet qualified. This decision was given by court on 27 September 2016 on the writ petition filed by lait udham Singh nagar. Petitioner said government appoint SM who are not UK TET or CTET qualified which is infringement of the rite to education RTE section 23 (2).
According to shiksha ka adhikari adhiniyam section 23, if their will be any type exemption will be given in teacher appointment then it will be only valid after the gazette notification of central government. However central government yet not given any type of exemption from TET for the appointment of primary school teacher to any state including Uttarakhand UK and Uttar pradesh up.
However NCTE has given exemption in their letter of 17 February 2014 which is illegal because NCTE (national council of Teacher education) has no right of giving any type of exemption from the teacher appointment.
Petitioner also given the reference of HC Allahabad court decision related to shiksha Mitra Samayojan in which court said this Samayojan of SM is illegal. After that government of UP challenged this decision in supreme court and matter is still pending in SC.

उत्तराखंड: शिक्षा मित्रों को HC से झटका, बिना TET पास नियुक्तियां होंगी रद्द
मंगलवार को हाईकोर्ट ने शिक्षक पात्रता परीक्षा उत्तीर्ण न करने वाले शिक्षक मित्रों को जोर का झटका दिया है। हाईकोर्ट ने शिक्षा मित्रों की नियुक्ति प्रारंभिक शिक्षक के रूप में करने के मामले पर सुनवाई के बाद टीईटी न करने वाले उन शिक्षा मित्रों को हटाने के निर्देश दिए हैं।
यायमूर्ति सुधांशु धूलिया की एकल पीठ में ऊधमसिंह नगर निवासी ललित व अन्य की याचिका में कहा गया था कि सरकार ने शिक्षा मित्रों को बिना शिक्षक पात्रता परीक्षा के शामिल किया है, जो कि शिक्षा के अधिकार अधिनियम की धारा 23 (2) का उल्लंघन है।
शिक्षा के अधिकार अधिनियम की धारा 23 के अनुसार अध्यापक की नियुक्ति में यदि कोई छूट प्रदान की जाती है तो वह केवल भारत सरकार गजट अधिसूचना के जरिए कर सकती है। भारत सरकार की ओर से अध्यापक पात्रता में कोई छूट नहीं दी गई है।
पात्रता की छूट एनसीटीई के 17 फरवरी 2014 के पत्र के अनुसार दी गई है। यह भी गलत है। छूट देने का प्रावधान अधिनियम में केवल भारत सरकार को है। एनसीटीई को केवल शैक्षिक अर्हता लागू करने का अधिकार है।
याचिकाकर्ता के अधिवक्ता ने इलाहाबाद हाईकोर्ट की ओर से पारित शिक्षा मित्रों के निर्णय का भी हवाला दिया। कहा गया कि इसमें शिक्षा मित्रों की नियुक्ति प्रारंभिक शिक्षक के रूप में करना अवैध ठहराया गया है।
